2. Heard learned advocate for the petitioner.

3. This application is filed with a prayer for expeditious completion of proceedings being G.R. Case No. 663 of 2017 corresponding to Berhampore Police Station Case No. 191/2017 dated 17.02.2017 now pending before the learned Judicial Magistrate, 3rd Court, Berhampore, Murshidabad.

4. It is the contention of the petitioner that although this case was instituted in 2017 and the Charge-sheet submitted on the self-same year and the case was transferred to the Court of learned Judicial Magistrate, 3rd Court, Berhampore, Murshidabad on 22.03.2018 but till today the case could not be taken up for consideration of Charge.

5. Learned advocate for the petitioner submits that one of the co-accused person died in the year 2017 but pending death report the matter could not be taken up.

6. In the facts and circumstances, this Court is of the view that no fruitful purpose will be served by keeping this matter pending, thus, this matter is disposed with a request upon the learned Judicial Magistrate, 3rd Court, Berhampore, Murshidabad to expedite the case and take a decision with regard to the death report and decision with regard to the consideration of the Charge within a period of two months from the next date fixed.
