Swapan Kumar Pan v. State Of West Bengal & ORS
28.8. 2025 item No.22 n.b.
ct. no. 24 WPA 14816 of 2019 with IA CAN 1 of 2025 Swapan Kumar Pan Vs.
State of West Bengal & Ors.
Mr. Sankha Subhra Roy, .... For the petitioner.
Mr. Suddhadev Adak, Ms. Richa Pramanik, ..... for the State.
In Re. CAN 1 of 2025 This is an application for restoration of the writ petition by recalling of an order dated July 4, 2025. It appears that the instant writ petition was dismissed for default on July 4, 2025 by this Court. Learned counsel for the petitioner submits that due to other engagement in the different court, he could not appear before this Court on the day of hearing. So, he prayed for recalling of the said order. It appears that the instant writ petition dismissed for default on July 4, 2025, the instant application for restoration was filed within ten days from the date of dismissal.
Considering the entire grounds mentioned in the application being CAN 1 of 2025 and also considering the fact that the application for restoration was filed by the petitioner promptly. I find justification to allow the same as sufficient ground. Thus, the application being CAN 1 of 2025 is considered and allowed. The order
dated July 4, 2025 passed by this Court is hereby recalled. The writ petition being WPA 14816 of 2019 is hereby restored to its original file and number. Accordingly, CAN 1 of 2025 is disposed of.
Let the matter appear two weeks after Puja Vacation.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
