The petitioner is a head teacher of Kamalpur Adarsha Vidyaniketan Shyamnagar Circle of DPSC, North 24 Parganas. She has complained against the private respondent on various occasions on account of insubordination and indiscipline. She has also challenged the validity of appointment of the private respondent and a complaint has been received by the District Primary School Council, North 24 Parganas who made enquiry held on 12th April, 2023. The allegations against the private respondent are found to be unsubstantiated.

There is total number of six teachers including the head teacher in the said school. The Chairman of the DPSC has not found any irregularity in the appointment of the private respondent.

Learned counsel for the private respondent would submit that there are several allegations of irregularities in the Midday Meal Scheme implemented in the school.

Having heard the learned counsel for the parties, this Court is of the view that the atmosphere in that particular school appears to have been vitiated by the reason of bad blood between the petitioner and the private respondent. The Court therefore directs the Chairman of the District Primary School Council, North 24 Parganas to transfer the writ petitioner to another school not to far away from the petitioner's residence.

This transfer should not be treated as penal. The aforesaid order is passed without any aspersion or stigma on the petitioner but only with a view to ensure peace in the school and in the interest of the students thereat.

The Block Development Officer, Barrackpore Circle shall look into the allegations of irregularities in the Midday Meal Scheme implemented in the school in question and take a positive step in accordance with law.

In the result, the writ petition is disposed of. 8.
