Amol Babar v. State Of West Bengal
14.07.2023 sdas rejected C.R.M.(DB) No. 2693 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Bamongola Police Station Case No. 124 of 2022 dated 12.05.2022 under Sections 394/323/34 of the Indian Penal Code and adding Section 395 of the Indian Penal Code.
And In Re : Amol Babar .... petitioner Ms. Suman Biswas ....for the petitioner Mr. Prasun Kumar Datta, learned APP Mr. N. Dhali ...... for the State Report is placed on record.
It appears from the report delay in the matter is due to abscondence of the co-accused. Petitioner does not stand on the same footing with co-accused who are on bail. He had been identified during test identification parade examination. Under such circumstances, we are not inclined to grant bail to the petitioner at this stage.
The application for bail is, thus, rejected.
