This application under Article 227 of the Constitution of India is at the instance of the respondent in Title Appeal No.28 of 2022, praying for a direction upon the learned Additional District Judge, Fast Track Court - I at Tamluk, to dispose of the Title Appeal expeditiously.

Learned advocate appearing for the petitioner submits that the opposite parties herein preferred a Title Appeal and since the same was filed beyond the statutory period of limitation, the same was accompanied by an application under Section 5 of the Limitation Act. Learned advocate appearing for the petitioner submits that the application under Section 5 of the Limitation Act is pending since December, 2022. It is also submitted that the

application under Section 5 of the Limitation Act is otherwise ready for hearing as the written objection thereof has already been filed by the petitioner herein.

Heard the learned advocate appearing for the State Electricity Distribution Company Limited. In the light of the submissions made by the learned advocate for the petitioner C.O. 2505 of 2025 stands disposed of by requesting the learned Additional District Judge, Fast Track Court - I at Tamluk to take up the hearing of the application under Section 5 of the Limitation Act on the next date fixed, i.e., on August 20, 2025 and to make an endeavour to dispose of the same as expeditiously as possible, without granting any unnecessary adjournments to either of the parties.
