In pursuance of the direction passed by this Court, a report is submitted by the I.C., Bankura P.S. along with a photocopy of certificate issued by the Superintendent, Midnapore Central Correctional Home which indicates that the appellant/convict Laru @ Lalu Gorai was released after getting the benefit of UT period set off and remission for 402 days. Let the report be taken on record.

The appellant/convict has already served out the sentence as passed by the learned trial court in the impugned judgment and order of conviction.

As the appellant/convict has already served out the sentence, this appeal is liable to be dismissed on merit. 6.

The impugned judgment and order of conviction passed by the learned trial court dated 28.02.2006 passed in connection

with Sessions Trial No. 2 of December, 2005 (Sessions Case no. 15 of November, 2005) is hereby affirmed.

Accordingly, the instant appeal be and the same is hereby dismissed on merit.
