07.07.2023 Sl. No.31 akd [Rejected] C. R. M. (DB) 2694 of 2023 In Re: An application for bail under Section 439 of the Code of Criminal Procedure filed on 03.07.2023 in connection with Santipur Police Station Case No.281 of 2023 dated 20.03.2023 under Sections 307/325/34 of the Indian Penal Code.

And In Re: Biswanath Singh @ Bapi ... ... Petitioner Ms. Sananda Bhattacharya ... ... for the petitioner Mr. S. S. Imam Mr. S. Kundu ... ... for the State It is submitted on behalf of the petitioner that he is in custody for about 41 days. Investigation is complete. Accordingly, he prays for bail.

Learned Advocate for the State opposes the prayer for bail. We have considered the materials on record. Statement of the victim recorded under Section 164 of the Code of Criminal Procedure shows petitioner administered a drink and thereafter, the victim became ill. Medical papers show that the victim had suffered poisoning. In view of the aforesaid incriminating materials, we are not inclined to grant bail to the petitioner at this stage.

The application for bail is thus rejected.
