Roy Mr. Partha Sarathi Pal ...for the Registrar of Cooperative Society This writ petition has been filed challenging an award dated June 14, 2024, passed by the Arbitrator in Dispute Case No. 18/KMAH of 2023.

Subsequent to the issuance of the award, the petitioners preferred an appeal before the Co-operative Tribunal, which was registered as Appeal No. 30 of 2024.

Mr. Biswaroop Bhattacharjee, learned advocate appearing for the petitioners, submits that due to the non-functionality of the Tribunal, the petitioners were unable to proceed with the appeal and, consequently, filed the present writ petition before this Court challenging the said award.

It is undisputed that the Tribunal is now functional.

In light of this, there is no justification for keeping this writ petition pending.

Accordingly, WPA 16663 of 2024, along with CAN 1 of 2024, CAN 2 of 2024 and CAN 3 of 2024, is disposed of without any order. The petitioners are granted liberty to proceed with the appeal. Since the appeal has been pending for a considerable period, it is desirable that the appeal be disposed of expeditiously, preferably within six months from the date.

Urgent certified photocopy of this order, if applied for, be supplied to the parties on compliance of usual legal formalities.
