Learned advocate appearing for the petitioner submits that the case was registered in the year 2011 and charge was framed in the year 2017; till date only two witnesses have been examined by the prosecution and some more witnesses about another four witnesses are yet to be examined. The petitioner is anxious regarding the slow progress of the trial as he is already in the court for the last 11 years. Having regard to the contentions advanced by the petitioner, I am of the opinion that the learned trial court should at least afford one date in a month so that the trial of the case can be taken to its logical conclusion within a reasonable period of time.

Needless to state that such date would be fixed after the learned public prosecutor conducting the case assures the court regarding the availability of the witnesses.

In case, any witness is absent without any reasonable grounds, the learned court would be at liberty to exhaust harsher process of law for compelling the appearance of the witness on the date so fixed.

No unnecessary adjournment should be granted to any of the parties and all efforts must be made to conclude the trial.

With the aforesaid observations, the revisional application being CRR 2113 of 2021 is disposed of. All pending connected applications, if any, are consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
