07.07.2023 sdas rejected C.R.M.(NDPS) No. 1229 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Baduria Police Station Case No. 679 of 2020 dated 22.11.2020 under Section 21(c ) of the NDPS Act.

And In Re : Jamir Ali Mondal .... petitioner Mr. Angshuman Chakraborty Mr. S. S. Saha ....for the petitioner Mr. Saibal Bapuli, learned APP Mr. Bibaswan Bhattacharya Mr. Arijit Ganguly ...... for the State Learned Counsel for the petitioner submits he is in custody for more than two years. It is also submitted petitioner prays for bail on the ground of inordinate delay. Learned Counsel for the State opposes the prayer for bail and submits trial is in progress. Time schedule fixed by this Court to conclude the trial by a learned Single Judge of this Court in CRR 3456 of 2022 has not expired.

We have considered the materials on record. In view of the aforesaid fact and as trial has progressed considerably we are of the opinion petitioner has not been able to make out a case for grant of bail on the ground of inordinate delay. Under such circumstances we are not inclined to grant bail to the petitioner.

The application for bail is, thus, rejected.
