The writ petition was preferred as the petitioner was aggrieved for interference in respect of the tractor which he was plying. Records of the writ petition reflect that the Financer being Kotak Mahindra Bank recalled the loan as well as invoked the guarantee for the loan granted to the present petitioner.

Having regard to the fact that such relationship between the petitioner and the respondent no. 4 was on the basis of a hire purchase agreement, I am of the view that petitioner would approach the appropriate civil court for remedies. As none appears for the State, Ms. Barnali Gupta, learned advocate who ordinarily appears for the State is directed to represent the State. Her appearance may be regularized by the concerned authorities.

Having regard to the directions passed above, I am of the view that no further interference is called for.

Accordingly, WPA 16662 of is disposed of.
