It appears that the police authorities enquired into the disputes between the parties and have taken steps. Pursuant to the directions of the learned Sub-Divisional Executive Magistrate at Hooghly, the proceedings under Section 107/116(3) of the Code of Criminal Procedure against the respondent nos. 6 to 9 was submitted. Parties have been directed to maintain peace. The dispute is over cultivation.
The petitioner now prays that police assistance be granted during the cultivation seasons the dispute is over L.R. Dag nos. 1338 & 1064 of Mouza Hatni. Under such circumstances, the petitioner is granted liberty to approach the Superintendent of Police, Hooghly, for police assistance. The said authority upon assessing the ground reality and the issues which shall be raised by the petitioner, decide whether police assistance must be given or not. If police assistance is ultimately allowed, the petitioner shall bear the costs thereof.
This writ petition is disposed of.
The police report is taken on record.
There will be, however, no order as to costs. All the parties are directed to act on the basis of the server copy of this order.
