Mondal ... for the petitioner Mr. Debjani Sengupta, Mr. Abhijit Chatterjee ... for University Mr. Taraprasad Haldar .. for respondent No. 3 & 4 The petitioner intends to pursue B.Ed Course under Vidyasagar University from the Yogoda Satsanga Palpara Mahavidyalaya. He took part in the admission process as per the admission schedule published by the College. According to the petitioner his name appears at Serial No. 409, Rank 33 of the merit panel. The petitioner thereafter logged on the official portal of the College for making the online payment for admission.

The petitioner submits that due to technical glitches the payment could not be made online within the time as specified.

The petitioner claims that immediately thereafter the petitioner contacted over the official mobile number and enquired whether he could make the payment offline. The petitioner submits that without getting any response from the college authority he made written

representation before the College on 30th September, 2021 which is annexed at page 23 of the writ petition. The petitioner prays for a direction upon the college authorities to permit him to pay the fee in the offline mode or by any other mode of payment so that he can take admission in the College.

None appears on behalf of the College despite service. Affidavit of service filed in Court is taken on record. The petitioner submits that admission process is going to be concluded by the College very soon. In view of the aforesaid circumstances, that the admission is going to be over shortly, the Court thinks it fit to direct the college authorities being the respondent Nos. 5 and 6 to take a decision with regard to the prayer of the petitioner as forwarded in his representation dated 30th September, 2021 at the earliest, but positively within a period of a week from the date of communication of a copy of this order.

In the event the College is convinced that the petitioner could not make the payment online due to technical issues, then the College may permit the petitioner to be admitted by accepting the fees from him. The order is being passed only upon submission made by the petitioner that his name is appearing in the merit panel (rank 33) and he is eligible for admission in the said College.

If all the vacancies are filled up in the meantime, then the College may take appropriate step as deemed fit and proper.

The petitioner is directed to forward the aforesaid respondent copy of the representation dated 30th September, 2021 along with supporting documents at the time of communicating the order of this Court. The writ petition stands disposed of.
