Proceeding being Special Case No. 6/12 arising out of G.R No. 66/2011 in connection with Mal P.S case no 7/11 under Sections 406/409 IPC pending before the Court of the learned Chief Judicial Magistrate, Jalpaiguri, is quashed. However, there shall be no order as to costs. Copy of the judgment be sent down to the trial court at once for necessary compliance.
