Affidavit-of-service filed on behalf of the petitioner is taken on record.

In the writ petition memo dated 24th January, 2025 issued by the Secretary, West Bengal Central School Service Commission is questioned. During course of hearing it is found that vide order dated 10th December, 2024 passed on a writ petition being WPA 25144 of 2024 Chairman, West Bengal Central School Service Commission was directed to take decision on transfer application of the petitioner within a specified time. But in derogation to the said order dated 10th December, 2024 Secretary of the Commission took decision by issuing memo dated 24th January, 2025. 3.

On this sole ground that Secretary was not authorized to take decision on transfer application of the petitioner in terms of the order passed by this Court

on 10th December, 2024, memo dated 24th January, 2025 is set aside. However other aspects relating to transfer application of the petitioner are not examined at this stage and all those issues are kept open. 4.

In terms of the previous order dated 10th December, 2024 passed by this Court Chairman, West Bengal Central School Service Commission being respondent no.4 is directed to decide transfer application of the petitioner by fortnight from date and the decision to be communicated to the petitioner by seven (7) days thereafter.

Writ petition stands disposed of.
