Since it was a case of dying-in-harness, the present petitioner made an application for getting a job. On being refused, a writ petition being CO No. 3580 (W) of 1994 was filed in this Court. Hon'ble Justice Paritosh Kr. Mukherjee as His Lordship then was, in terms of Order dated 21.02.1994 disposed of the writ application directing to dispose of the matter within two weeks from the date of communication of the order. The Director of the School Education, West Bengal was so directed.

There was further direction that the Director of School Education should pass a reasoned order in case of compassionate appointment of the petitioner was not acceptable. It is submitted by Mr. Biswas that the present petitioner has crossed the age limit for which he is no longer eligible for the appointment.

present petitioner has crossed the age of retirement, the very basis of the application has become infructuous. Accordingly the instant application stands disposed of.

The writ petition shall also disposed of accordingly.
