Petitioner complains that his property is being 20.03.2025 Court No. 35 Item No.56 Rakib attempted to be grabbed by the private respondents and they are also raising illegal construction by way of violating the order of the Civil Court in T.S. 29/20. Petitioner further complains that he is unable to take any step as a cease work proceedings are existing in the learned Court below and as such has approached this Court.

The documents enclosed alongwith the writ petition reflected that an application under Order XXXIX Rule 2A and Section 151 of Code of Civil Procedure is pending.

Having regard to the fact that the Civil Court is already in seisin of the disputes, at this stage the only direction which can be passed is to the extent that if the Civil Court passes any directions upon the police authorities, police authorities would respect, obey and implement of the order of the learned Civil Court. With the aforesaid observations WPA 16636 of 2024 is disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
