In terms of order dated 18th August, 2025, report dated 1st September, 2025 is filed by the District Inspector of Schools (SE), Purba Medinipur being respondent no. 5 and same is taken on record.

On perusal of report dated 1st September, 2025, it appears that roll strength of Narayanchak High School, Purba Medinipur (hereinafter referred to as "said school") from Classes V to XII is 975 (nine hundred and seventy five) whereas at present thirteen teachers are working including petitioner. It is also disclosed in the report based on letter dated 27th August, 2025 of the

Headmaster of said school that there are twentyfour sanctioned teaching posts in said school but eleven posts are lying vacant. It is submitted that due to poor People Teacher Ratio „no objection‟ was not granted on transfer application of the petitioner in order to permit the petitioner to take transfer.

Said school authorities are represented by Mr. Prasad, learned advocate who has submitted that Administrator is functioning in said school from 2016 and there is no Managing Committee but Administrator has not been arrayed as party respondent. Therefore, writ petition suffers from defects of parties.

Since application for transfer was made by the petitioner on the ground of distance and not on medical ground considering the transfer rules it is found poor Pupil Teacher Ratio is relevant consideration in permitting the applicant-teacher to take transfer. In the said school against 975 (nine hundred and seventy five) students thirteen teachers are working including the petitioner and as such poor Pupil Teacher Ratio does not permit transfer of the petitioner on the ground of distance.

Hence, no relief can be granted to the petitioner and writ petition stands dismissed.

However, this order shall not preclude the petitioner to make application for transfer in future in accordance with law if Pupil Teacher Ratio is improved.
