The Inspector-in-charge, Mongalkote Police Station has filed an enquiry report dated 7th September, 2022 addressed to the State Advocate that has been taken on record.
It appears in no uncertain terms of the said report that the elder son, namely, Kartick Ghosh and his wife Namita Ghosh do not reside in the said premises along with the petitioner, and the allegations against Kartick Ghosh appear to be baseless.
It also clearly appears to this Court that the petitioner, who is present in Court today, may not even understand or know of the statements made in the writ petition. The allegations against the elder son appear to have been made by the other children. It also appears from the report of the Mangalkote P.S. that the petitioner had gone to her sister, Ira Ghosh for sometime and was to come back to her residence after a few days and the statement is confirmed from the local villagers.
The instant writ petition is, therefore, wholly motivated and the statements made therein are utterly dishonest. The writ petitioner may not have any knowledge or have made such statements at all. This Court, therefore, direct the Inspector-incharge, Mongalkote Police Station to issue a stern warning to the two younger sons, namely, Nikhil Ghosh and Partha Sarathi Ghosh, against any kind of such misadventure.
The said Nikhil Ghosh and Partha Sarathi Ghosh shall pay costs assessed at Rs.1,100/- each to the said elder son Kirti Mohan Ghosh/Kartick Mohan Ghosh.
The instant writ petition must fail and is hereby dismissed.
There will be no order as to costs.
