The petitioner is working as a Motor Vehicle Inspector (Technical) in the Transport Department of the Government of West Bengal.

The petitioner is admittedly a State Government employee.

The grievances of the petitioner are, inter alia, in respect of promotion in service. The petitioner, in view of the provisions of the Administrative Tribunals Act, 1985 (in short '1985 Act'), is required to ventilate his grievances before the State Administrative Tribunal. Although the petitioner says that his fundamental rights guaranteed under Articles 14, 16 and 19 are infringed and there is also violation of principles of natural justice, but, in view of the specific provisions in the 1985 Act, I am of the view that the State Administrative Tribunal is the proper forum.

The writ petition is dismissed as withdrawn with liberty to file afresh before the proper forum on the selfsame cause of action. All parties shall act on the server copies of this order duly downloaded from the official website of this Court.
