Since the order we propose to pass shall not adversely affect the respondents, we decided to dispose of the writ-petition in their absence. This writ-petition has been preferred by the petitioners being aggrieved by the order dated April 20, 2021 passed by the Fourth Bench of the West Bengal Land Reforms and Tenancy Tribunal.
Learned Lawyer appearing for the petitioners, submits that though the tribunal application was taken up by the learned Bench of the Tribunal on April 20, 2021 but the learned Tribunal posted the matter for hearing on March 9, 2022. Learned Lawyer submits that the Tribunal be directed to dispose of the application expeditiously.
The order impugned reads as under:- "Since we are busy in disposal of old T.A. matters and in view of Establishment order regarding running of this Tribunal with 50 per cent of the sanctioned strength of the
supporting employees due to fresh outbreak of Corona Virus (Covid-19) in the second phase, for the ends of justice, the hearing of this case is adjourned."
This Court on previous occasion noticed similar observations made by the aforesaid Bench in respect of other matters. This Court took serious exception to the observations made by the learned Bench in passing such orders in slipshod manner. We feel that without having any further observation as sermonizing, the learned Tribunal be directed to dispose of the tribunal application within three months from the date of communication of this order. With these observations, the writ-petition being WPLRT 52 of 2021 is disposed of.
