The instant application is filed under Section 401 read with Section 482 of the Code of Criminal Procedure praying for quashing of the proceedings being Special Case No. 01 of 2009 pending before the learned Judge, 2nd Special Court, Darjelling in connection with G.R. Case No. 167 (1) of 2008 filed in the Court of Additional Chief Judicial Magistrate, Kurseong.

None appears for the petitioner.

On perusal, it appears that the application along with annexures and the written complaint disclose prima facie incriminating materials against the present petitioner, which do not warrant interference of this Court.

Accordingly the instant application stands dismissed on merit.
