Affidavit-of-service filed by the petitioner be kept with the record.

Petitioner is aggrieved by the fact that at the time of survey the private respondents were adamant in obstructing the same and to that effect, they have assaulted the petitioner and in spite of informing the police authorities, no steps have been taken. On the other hand, learned advocate for the State has submitted a report. Report reflects that proceedings have been drawn up under Section 126 of the BNSS. Specific General Diary Entry has been also drawn up at the police station.

Learned advocate for the private respondents submits that the dispute complained of is a civil dispute.

In case there is an issue relating to survey, petitioner will apply before the appropriate land authorities. In case any dispute arises and police assistance is sought for, police will render appropriate assistance after receiving information from the concerned officers of the land department. Police authorities have already drawn up proceedings under Section 126 of the BNSS, they would continue their surveillance and ensure that there is no unrest at the behest of the parties.

With the aforesaid observations, WPA 15705 of 2025 is disposed of.

There will be no order as to costs.

Report submitted by the State be kept with the record.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
