Heard learned counsels for the parties.

The petitioner who is a retired employee under respondent No.3 complains that he has not been granted gratuity due to him even after superannuation. A notice for payment of gratuity was issued by the Controlling Authority upon respondent No.3 on 5th March, 2018 as against which this respondent preferred an appeal before respondent No.2 on 4th May, 2018. The petitioner submits that the said appeal is still pending for which the petitioner is being deprived of his legitimate dues.

Having considered the submissions made on behalf of the parties and material on record, I dispose of the writ petition with a direction upon the respondent No.2 (Appellate Authority) to dispose of the appeal being GRA07/2018 on merits within a period of three months from

the date of communication of this order after giving opportunity of hearing to all the affected parties including the petitioner, in accordance with law.

Accordingly WPA 16983 of 2021 is disposed of. However, there shall be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
