Mr. Aritra Basu, Ms. Sonia Sharma ... for the petitioners Mr. Satyajit Talukdar, Mr. Abhishek Sarkar, ... for the KMDA The only prayer of the petitioners is for a direction on the Kolkata Metropolitan Development Authority (KMDA) to execute and register the deed of conveyance in relation to built-up space allotted to the petitioners in 2004. The petitioners are in possession of the space but three representations made by the petitioners to the KMDA have gone unanswered.
Learned counsel appearing for the KMDA submits that the KMDA may be directed to consider and dispose of the representations made by the petitioners. After hearing learned counsel, WPA 16218 of 2022 is disposed of with a direction on the respondent no. 2 being the Special Secretary, Kolkata Metropolitan Development Authority, to consider the representations
made by the petitioners, the last of which was made on 28th January, 2022 and dispose of the same by passing a reasoned order within a period of two weeks from the date of communication of this order after giving an opportunity of hearing to the petitioners. A copy of the reasoned order shall be made available to the petitioners within a week from the date of passing such order. This Court notes the inordinate delay on the part of the KMDA to respond to the representations made by the petitioners from 2019 onwards.
Since affidavits have not been called for, allegations made in the writ petition are deemed not to have been admitted.
