Maity Mr. Bidish Ghosh ...for the private respondent no. 11 Re The petitioners claim that on the foundation of certain forged documents, the private respondents had taken advantage for establishing their title over a plot of land. To that effect, information was furnished to the Inspector in charge of Banshihari Police Station. However, no steps have been taken. The petitioner is aggrieved particularly with regard to the earlier order passed in WPA 9390 of 2025.
Learned advocate for the private
respondent(s) submits that an Appeal was preferred by the petitioners against the order passed by the concerned authority.
The said appeal, according to the private respondents, was dismissed. Subsequent to which, the writ petition has been preferred.
Learned advocate for the State is present.
Having considered that so far as the right, title and interest of the plot of land is concerned, this Court will not interfere with the same and it is for the for the parties to settle such dispute before the civil court.
If the petitioners have in their possession any documents to substantiate their claim that documents have been forged to establish title at the behest of the private respondents, in that case, the petitioners would approach the jurisdictional Magistrate under Section 175(3) of the BNSS.
The learned Magistrate would
assess as also ascertain in respect of the accusations, thereafter, pass necessary directions as he/she deems fit and proper.
With the aforesaid observations, WPA 15660 of 2025 is disposed of.
Pending application(s), if any, is also disposed of.
