1. Liberty is granted to the petitioners to make necessary correction in the prayer portion.

2. Learned Advocate for the petitioners is present. Heard the learned Advocate for the petitioners.

3. The petitioners in the instant case is the defacto complainant of Narkeldanga Police Station Case NO. 125 dated 12th April 2012 now pending before the Court of Learned Judicial Magistrate, 2nd Court at Sealdah.

4. It is the contention of the petitioners that although the case was instituted on 12th April 2012 and charge-sheet submitted on 8th May 2013 and charges framed on 21st January 2014, but till today examination of the defacto complainant is not over.

5. Learned Advocate for the petitioners submits that several dates the matter appeared, but till today the examination of the defacto complainant could not be completed.

6. In the facts and circumstances, this Court is of the view that no fruitful purpose will be served by keeping this matter pending and directing service of notice.

7. Thus, this application is disposed of with a request upon the learned Judicial Magistrate, 2nd Court at Sealdah to dispose of the G.R. No. 1062 of 2012 expeditiously and preferably within a period of six months from the next date fixed. (Biswaroop Chowdhury, J.)
