Filing this application under Section 482 read with Section 401 of the Code of Criminal Procedure, 1973, the petitioner praying for setting aside the order dated 25th March, 2021 passed by the learned Judicial Magistrate, 3rd Court, Chandannagore, Hooghly in a proceeding under Section 125 of the Code of Criminal Procedure being M.C. - 261/2018 (Riya Mukherjee vs Sourav Mukherjee).

This case is pending since 2021. In spite of long pendency, none appears on behalf of the petitioners at the time of call. No accommodation is sought for. Even on the earlier occasion, none appears on behalf the petitioner and no accommodation sought for.

In the above circumstances, it appears that the petitioners are no more interested to pursue the instant case.

Accordingly, CRR 2125 of 2021 is, thus, dismissed for default.

Interim orders, if any, shall stand vacated.

Let a copy of this order be communicated to the learned Trial Court for information.
