29.07.2025 W.P.A. 15579 of 2025 Item No.21 Ct. No.35 dc.

Srimati Ashalata Mahata & Ors.

versus The State of West Bengal & Ors.

Mr. Aritra Shankar Ray, Mr. Abhisek Mandal ... For the Petitioners.

Ms. Sipra Majumdar, Mr. Arunava Maity ... For the State.

Affidavit-of-service filed in Court today be kept with the record.

Report submitted by the learned advocate appearing for the State be also kept with the record. A copy of the report be handed over to the learned advocate appearing for the petitioners.

Petitioners are aggrieved by the fact that in spite of decree having been passed by the civil court in connection with Title Suit No. 191 of 2019, private respondent has been threatening the petitioners when they are intending to raise construction.

Police authorities have submitted a report which reflects that Jhargram PS NCR No. 260 of 2025 was registered on 03.07.2025 under Sections 170/126 of BNSS.

Since the police authorities are aware regarding the dispute between the petitioners and the private respondent, they would continue their surveillance and ensure that no breach of the peace and/or tranquility takes place.

So far as the other issues are concerned, civil court would decide the same. If there is breach of the order of the civil court, it would be the civil court to pass necessary directions upon the police authorities for implementing its order.

With the aforesaid observations, the writ petition being WPA 15579 of 2025 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
