C.R.R.2126 of 2021 D/L32 06.12.2022 Bpg.
In Re: An application under Section 482 of the Code of Criminal Procedure, 1973;
Gopal Bakshi
Versus
The Learned Public Prosecutor, High Court, Calcutta and others Mr. S.N. Mukherjee, Ms. Amrita Tewari, Mr. Chandranath Chattopadhyay, Mr. Varun Raj Tiwari.
...for the petitioner.
Mr. Avishek Sinha.
...for the State.
Mr. Aniruddha Tewari.
...for the opposite party no.3.
The revisional application was preferred challenging the proceedings relating to Madhyamgram Police Station Case No.439 of 2019 dated 14.10.2019 under Sections 420/406 of the Indian Penal Code.
Mr. Sinha, learned advocate appearing for the State submits that investigation of the case has concluded and chargesheet has already been submitted before the jurisdictional court. Learned advocate for the petitioner as well as private opposite party no.3 submits that talks of compromise are in progress.
Be that as it may, the revisional application cannot wait for a compromise to be effected. Parties are directed to approach this Court afresh in case there is changed of circumstances or a
compromise between them. There are no further reasons to keep the present revisional application pending.
Accordingly, CRR 2126 of 2021 is disposed of. Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
