Arvind Kumar Khetan & Anr.

-------- Re: CAN 2 of 2023 & CAN 3 of 2023 Mr. Kushal Chatterjee, Mr. Debrup Choudhury.

... for the applicant.

At the time of hearing of the instant applications it is contended by the learned Advocate for the respondent no. 1 that the respondent no. 2 is also dead having expired on 25th November, 2020 during the pendency of the instant appeal.

It appears that the instant application has been taken out for substitution of the applicant in place and stead of the deceased appellant on the ground of devolution of interest. Since the respondent no. 2 has also expired, steps are required to be taken by the applicant.

The learned Advocate appearing for the respondent no. 1 is directed to disclose the particulars and the details of the heirs and legal representatives of the deceased respondent no. 2 to the learned Advocate on record of the applicant by 12th September, 2023. Liberty is granted to the applicant to take appropriate steps.
