Pal ...for respondents no.2-6 The petitioner prays for a direction upon the special officer to conclude the proceeding pending before the said officer within a stipulated period of time. It appears that by an order dated August 22, 2022 passed by a co-ordinate Bench of this court in WPA No.14352 of 2021, the court directed the Registrar of Cooperative Societies to decide the issue. The Registrar of Co-operative Societies appointed the special officer for the purpose of conducting disciplinary proceeding and ordered that the said disciplinary proceeding be completed within the period stipulated in rule 106 of the West Bengal Co-operative Societies Rules, 2011, i.e. within three months from the date of submission of the application.

In the present case, it appears that the appeal is pending for nearly a year. The representation filed by the petitioner seeking permission to rejoin in service is also pending consideration.

As the court directed the Registrar of Cooperative Societies to decide the issue which was decided and the special officer was appointed to conclude the disciplinary proceeding, accordingly the Registrar of Cooperative Societies is directed to oversee the disciplinary proceeding and ensure that the same is concluded at the earliest, but positively by December 22, 2023. WPA No.15824 of 2023 is disposed of.

Learned advocate for the petitioner is directed to communicate this order to the Registrar of Co-operative Societies forthwith.

Certified copy of this order, if applied for, shall be made available to the parties.
