Filing this application under Section 401 read with Section 482 of the Code of Criminal Procedure, 1973, the petitioner praying for quashing of proceeding being case No. AC/1093/2019 pending before the Court of the learned Judicial Magistrate, 7th Court, Alipore, South 24 Parganas under Sections 406/420/421/403/506(ii)/120B of the Indian Penal Code.

This case is pending since 2021. In spite of long pendency, none appears on behalf of the petitioners at the time of call. No accommodation is sought for. Even on the earlier occasion, none appears on behalf the petitioner and no accommodation sought for.

In the above circumstances, it appears that the petitioners are no more interested to pursue the instant case.

Accordingly, CRR 2131 of 2021 is, thus, dismissed for default.

Interim orders, if any, shall stand vacated.

6.

Let a copy of this order be communicated to the learned Trial Court for information.
