Petitioner claims to be the owner of a property where he is raising construction and to that effect, he is resisted by the private respondent and even after informing the police authorities, no steps have been taken.

Learned advocate for the State has submitted a report. Report reflects that a dispute arose between the petitioner and the respondent no.8, Nasiruddin Molla over the issue relating to ownership of the land. To that effect, police authorities were informed. There were hot altercations regarding construction being raised by the petitioner at the plot referred to on many occasions.

Having considered the dispute between the petitioner and the private respondent no.8, police

authorities have drawn up proceedings under Section 126 of the BNSS. Since there is a dispute relating to land, the petitioner be well advised to approach the appropriate authorities of the civil court for necessary directions for raising construction. Police authorities are in knowhow of the issue of dispute, as such, they would continue their surveillance and ensure that there is no breach of the peace and/or tranquility and/or any untoward incident resulting from the strained relationship existing between the petitioner and the private respondent no.8.

With the aforesaid observations, WPA 15721 of 2025 is disposed of.

There will be no order as to costs.

Report submitted by the State be kept with the record.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
