The petitioners complain that the private respondents are encroaching upon their lands. Counsel for the private respondents submits that the petitioners are not even the owners of the said land and it is they who are in possession of the same. The parties also submit that the land is a vested land.

Pursuant to this, a complaint has been lodged with the Canning Police Station. Canning Police Station filed instructions addressed to the State Advocate dated 29th July, 2022 stating that the parties often confronted with each other over the possession of the property in question.

The parties may thrash out their civil disputes before an appropriate civil or statutory forum. The parties shall maintain peace in the area. Canning Police Station shall keep a strict vigil on the said locale and ensure that there is no breach of peace.

With the aforesaid directions, the instant writ petition shall stand disposed of.

There will be no order as to costs.
