1. Learned Advocate for the petitioner is present. Heard the learned Advocate for the petitioner.

2. Learned Advocate for the petitioner submits that the petitioner has filed a case under Section 125 of the Code of Criminal Procedure being M-45 of 2024 now pending before the learned Judicial Magistrate at Bongaon, North 24-Parganas. It is further submitted that although the case is pending from 2024, but till today, the application for interim maintenance is not taken up for hearing. It appears that by an order dated 5th June 2025, the learned Magistrate has fixed 24th March 2026 for hearing of the interim maintenance.

3. In the facts and circumstances, this Court is of the view that no fruitful purpose will be served by directing the service of notice upon the opposite party.

4. Thus, this application is disposed of with a request upon the learned Judicial Magistrate, at Bongaon, North 24-Parganas to dispose of the application for interim maintenance within a period of two months from the next date fixed.

5. There shall, however, be no order as to costs.

6. Urgent Photostat certified copy of this order, if applied for, be given to the parties on priority basis.
