In this writ petition the petitioner has challenged the impugned order dated 24th January 2019 passed by the District Inspector of Schools (SE), Howrah being Annexure P-10 to the writ petition rejecting claim of additional increment to the petitioner.

The petitioner submits that while passing the impugned order, the District Inspector of Schools (SE), Howrah/respondent no. 4 has not taken into consideration the order passed in WP 24810(W) of 2012 (Timirbaran Bhattacharya vs. State of West Bengal & Ors.) dated 6th October 2015.

Considering the submission of the parties, the impugned order dated 24th January 2019 is set aside with a direction upon the respondent no. 4 to consider the case of the petitioner afresh by taking into consideration the aforesaid judgment dated 6th October 2015 and if it is found that the case of the petitioner stands on same footing and the facts of the judgment is similar to the case of the present

petitioner, in that event the petitioner will allow same benefit as that of the petitioner of the said judgment, by a fresh order within eight weeks from the date of communication of this order in accordance with law and by passing a reasoned and speaking order after giving an opportunity of hearing to the petitioner or his authorized representative and will communicate its decision to the petitioner within two weeks thereafter.

WPA 14873 of 2019 is disposed of.
