The petitioner submits that her husband was a 'Group - D' employee at Jadavpur University.

The University allowed him to retire voluntarily on medical ground with effect from June 30, 2014. Thereafter, the petitioner by a letter dated July 11, applied before the Vice-Chancellor of the University for her compassionate appointment. It is the grievance of the petitioner that though she repeatedly made similar prayer before the University, no response thus far has been received from the University.

Having regard to the aforesaid facts, I dispose of this writ petition with a direction upon the appropriate authority of the University to consider the case of the

petitioner for compassionate appointment in accordance with law within a period of two months from the date of communication of this order. The authority of the university shall hear the petitioner before taking any decision.

I make it clear that the case of the petitioner shall not be rejected on the ground that she has received the retiral dues on account of voluntary retirement of her husband.

With the aforesaid observations/directions, WPA 16932 of 2017 is disposed of.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
