Upon hearing learned counsel and considering the communication dated 11th April, 2022 of the Deputy Secretary, Home and Hill Affairs Department, Government of West Bengal stating that the petitioner's appeal could not be considered since it was filed beyond time, WPA 16258 of 2022 is disposed of with a direction on the respondent no. 2 being the Home Secretary, Government of West Bengal to consider the application for condonation of delay filed by the petitioner and dispose of the same within a period of four weeks from date. If the application for condonation of delay is found to be in order, the respondent no. 2 shall dispose of the appeal filed
by the petitioner within a period of six weeks from today.
It is made clear that this Court has not gone into the merit of the matter.
It is noted that the petitioner has also paid the requisite Court Fees for the application for condonation of delay as well as for the appeal. Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertakings.
