Mr. Jayanta Mitra ..For the Petitioner Mr. Subhasish Pachhal ....For the Respondent Nos. 2 to 4 Mr. Prashant Kumar Tripathi ....For the Union of India Mr. Pachhal, learned counsel appears on behalf of the Steel Authority of India Limited (SAIL). He submits that this Court does not have the jurisdiction to entertain the present writ petition.

Considering the submissions of the parties and the materials placed on record, this Court is of the view that the appropriate Tribunal is the Court at first instance after considering the Apex Court's judgment in L. Chandra Kumar vs. Union of India & Ors. reported in (1997) 3 SCC 261.

Therefore, this Court is of the view that it does not have the jurisdiction to receive, try and entertain the present writ petition.

Accordingly, W.P.A. 15846 of 2023 is dismissed, with liberty to file afresh before the appropriate Forum, if so advised.

It is made clear that this Court has not gone into the merits of the writ petition.
