Matter is heard in presence of the leaned advocates representing the petitioner, State respondents and State Bank of India.

It is submitted on behalf of the petitioner though a complaint was lodged alleging commission of an offence but no steps have been taken by the police authorities.

On the contrary learned advocate representing the State respondents submits that the offence complained of is found to be non-cognizable, as a result whereof steps could not be taken.

In view of submission made on behalf of the respective parties writ petition is disposed of granting leave to the petitioner to approach the jurisdictional Magistrate.

applied for, be given to the parties, upon usual undertakings.
