Case No. 251 of 2023 dated 06.10.2023, although, the police authorities have conducted their investigation, but, no efforts have been exerted by the police authorities to recover the gold chain, ear ring and a cash of Rs.86,000/-, which were also the subject-matter of the complaint.

As none appears on behalf of the State, Ms. Ashima Das (Sil), learned

advocate, who ordinarily appears on behalf of the State, is directed to represent the State. Her appointment may be regularized by the concerned authorities.

In view of the contentions advanced in the writ petition, I direct the petitioner to take out an appropriate application before the learned jurisdictional Magistrate in seisin of Memari P.S. Case No. 251 of 2023.

If such an application is preferred, the learned jurisdictional Magistrate would dispose of the same in accordance with law preferably within a period of 45 days from the date of filing of such application upon notice to the learned Public Prosecutor.

With the aforesaid observations, WPA 17081 of 2024 is disposed of.
