Filing this application under Section 482 of the Code of Criminal Procedure, 1973, the petitioners praying for quashing of order dated 27.04.2021 passed by the learned Additional Chief Judicial Magistrate, Barrackpore in M.P. Case No. 746/2021, entertained as under Section 156(3) oft eh Code of Criminal Procedure and the same was registered as Ghola Police Station Case No. 278 dated 29.04.2021 under Sections 498A/308/406/450/506/120B/34 of the Indian Penal Code and 3⁄4 Dowry Provisions Act and referred to G.R. Case No. 3563/21 (Riya Dey @ Dutta -Vs- Biswajit Dey & 2 others).

This case is pending since 2021. In spite of long pendency, none appears on behalf of the petitioners at the time of call. No accommodation is sought for.

Even on the earlier occasion, none appears on behalf the petitioner and no accommodation sought for.

In the above circumstances, it appears that the petitioners are no more interested to pursue the instant case.

Accordingly, CRR 2139 of 2021 is, thus, dismissed for default.

Interim orders, if any, shall stand vacated.

Let a copy of this order be communicated to the learned Trial Court for information.
