Mr. Subrata Bhattacharyya, ... For the Petitioner.

Mr. Saryati Dutta, Ms. D. Biswas, ... For the State.

Order dictated by Arijit Banerjee, J.:

The petitioner says that he is in custody for about one and half years. Charge has been framed. Trial has not begun. He has no role to play in the alleged incident. He prays for bail. While opposing the prayer for bail, learned Advocate for the State in his usual fairness does not dispute that the principal accused persons are on bail.

We have seen the material in the case diary. On an overall assessment of the material on record, we are of the view that there is no further need to detain the petitioner in custody. Accordingly, we direct that the petitioner, namely, Sanjay Kumar Soni, shall be released on bail upon furnishing a bond of Rs. 10,000/-, with two sureties of like amount each, one of whom must be local, to the satisfaction of the Learned Additional District and Sessions Judge, 1st Court, Durgapur, Paschim Bardhaman and on further conditions that he shall not leave the jurisdiction of the concerned Police Station and shall report to the officer-in-charge of Signed By :

the concerned Police Station once in a week until further orders. The petitioner shall appear before the trial Court on every date of hearing until further orders and shall not intimidate the witnesses and/or tamper with evidence in any manner whatsoever. In the event the petitioner fails to adhere to any of the conditions stipulated above without justifiable cause, the trial court shall be at liberty to cancel the petitioner's bail in accordance with law without further reference to this court.
