Both the learned Counsel appearing on behalf of the appellant as well as the learned Counsel appearing on behalf of the opposite party no. 1 are present.

From the record it appears that one application was registered as CRMSPL/33/2023 but contents of that application is nothing but an appeal and accordingly it is found not in form. 3.

Thus, being the position the CRMSPL/33/2023 cannot be taken into account and stands dismissed with a liberty to file afresh subject to payment of cost of Rs.10,000/- to the High Court Legal Services Authority.
