The instant application under Article 227 of the Constitution of India is at the instance of the plaintiff in a suit for declaration of title and permanent injunction which is directed against order dated March 04, 2023 passed by the 3rd Court of the learned Civil Judge (Junior Division) at Baruipur, District: 24 Parganas (South) in the said suit being Title Suit No. 103 of 2014. To prove the registration certificate of the plaintiff club, the petitioner had prayed for recalling of P.W.1.; the learned Trial Judge, by the order impugned has refused the said prayer of the petitioner as the suit has matured to the stage of argument.

This Court does not find any illegality and/or infirmity in the order impugned warranting interference.

C.O. 2350 of 2024 is thus dismissed without any order as to costs.
