Tapas Kumar Raha @ Bapi v. State Of West Bengal & ANR
05.02.2021 Ct. No. 35 Sdas C.R.R. No. 2300 of 2018 With CRAN 1 of 2019 (Old No. CRAN 524 of 2019) (via video conference) In Re : An application under Section 482 of the Code of Criminal Procedure.
And In Re : Tapas Kumar Raha @ Bapi ...... petitioner Mr. Arnab Sengupta Mr. Souvik Dutta ... for the petitioner Mr. Prasun Kumar Dutta, learned APP Mr. Santanu Deb Roy ... for the State Mr. Sudarsan Roy ... for the opposite party no. 2 Report filed on behalf of the State along with annexures thereto be taken on record.
It appears that the matter has been amicably settled between the parties and the petitioner is not inclined to proceed with the case any further. Such contention of the petitioner has been verified to be true and correct.
In the premises, I am of the considered view that continuation of the proceeding shall be a futile exercise and shall lead nowhere.
Accordingly, petition for joint compromise/memorandum of understanding being CRAN 1 of 2019 (Old No. CRAN 524 of 2019) is allowed.
CRR 2300 of 2018 is disposed of on the basis of the petition for joint compromise.
G.R. Case No. 657 of 2016 pending before the learned Judicial Magistrate, 5th Court, Hooghly, be quashed. There will be no order as to costs.
