Petitioner has approached this Court being 07.08.2025 Court No. 35 M/L. No.746 Rakib aggrieved by the inaction of the police authorities. Categorically it was stated that there has been noncompliance in respect the order dated 08.01.2024 and 07.03.2024 passed by the learned Judicial Magistrate, 4th Court, Alipore which is a proceedings under Section 23 of the PWDV Act. Petitioner also prayed for registration of First Information Report in respect of the complaint which was addressed to the police authorities. State has submitted a report. Report reflects that police authorities have initially registered Anandapur Police Station case no.
294/23 under Sections 498A/406/506/323/34 of the Indian Penal Code.
Charge-sheet was submitted on conclusion of investigation. Subsequently, Anandapur Police Station case no. 143 dated 04.08.2024 was also registered for investigation which had its genesis in respect of the complaint dated 07.03.2024.
Learned advocate for the respondent no.6 denies and disputes the contents of the writ petition and further
submits that since no affidavits have been called for, the accusations which have been made in the writ petition are deemed not to have been admitted.
Having considered that the police authorities have responded to the grievance of the petitioner, I am of the view that further interference at this belated stage is unwarranted.
With the aforesaid observations WPA 16793 of 2024 is disposed of.
Report so submitted by the State be kept with the record.
