Mondal ........for the State 1) In terms of order dated 19th August, 2025 a report is filed by the Deputy Director In-Charge, School Education Department, Secondary Education dated 11th September, 2025 and same is taken on record.

2) It is stated in the report dated 11th September, 2025 by the Deputy Director In-Charge, School Education Department, Secondary Education since post of Joint Director of Accounts is lying vacant report is filed by the Deputy Director InCharge. In the report dated 11th September, 2025 it is also stated that as relevant memo relating to sanction of 3% additional increment was set aside by a coordinate Bench vide judgment dated 15th January, 2024 passed on a writ petition being WPA 6217 of 2021 (Subir Kumar Ghosh Vs. The State

of West Bengal & Ors.) State authorities are to follow the order of the Court in settling pension case of the petitioner.

3) It needs to be clarified herein that relevant memo relating to grant of 3% additional increment for manning the post of Headmaster in upgraded higher secondary school is dated 22nd March, 2017 not 23rd March, 2017, being memo no. 292-SL/5S294/12. 4) Since issue has already been decided by the coordinate Bench in Subir Kumar Ghosh (supra) objection raised by JDA/DDA/ADA as it appears from the page 65 of the writ petition is not tenable and petitioner is entitled to receive 3% additional increment since he worked as Headmaster of upgraded higher secondary school.

5) Therefore, State authorities are directed to settle the pension case of the petitioner without raising any objection relating to sanction of 3% additional increment in favour of the petitioner and without insisting upon the petitioner to refund excess drawn amount, within a period of six weeks from date of communication of this order.

Concerned State authorities are also directed to release retiral dues on issuance of Pension Payment Order in favour of the petitioner at an early date but

not later than 10 weeks from date of communication of this order.

6) Writ petition stands disposed of.

7) There shall be no order as to costs.

8) Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
