25.07.2022 sdas rejected C.R.M.(NDPS) 823 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Jalangi Police Station Case No. 46 of 2021 dated 01.03.2021 under Section 21(c )/29 of the NDPS Act.

And In Re : Toslim Mondal & Ors. .... petitioners Mr. Jisan Iqubal Hossain ....for the petitioners Mr. Binay Panda Ms. Puspita Saha ...... for the State Heard learned Counsels for the parties.

Statements of witnesses and contemporaneous documents show recovery of 90 bottles of Phensedyl Syrup containing codeine mixture above commercial quantity from the petitioners. Under such circumstances and in view of statutory restrictions under Section 37 of the NDPS Act, we are not inclined to grant bail to the petitioners.

The application for bail is, thus, rejected.

In view of protracted period of detention suffered by the petitioner, we direct the trial court to expedite the trial and conclude the same at an early date without granting unnecessary adjournment to either of the parties. (Ananya Bandyopadhyay, J.) (Joymalya Bagchi, J.)
